Are Journalists Legally Privileged to Protect their Sources?

According to First Amendment attorney Floyd Abrams, who will be filing papers with the Supreme Court this week on behalf of Judith Miller of the NY Times and Matt Cooper of Time Magazine, in an attempt to protect a confidential source who outed the identity of CIA agent Valerie Plume:

“We have to persuade the court that even if there is a privilege, that we should win on that privilege…”
